Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Instagrow governing your use of instagrowapp.com and all related services. By registering an account or using the Service, you confirm you have read, understood, and agree to these Terms, our Privacy Policy, and our Cookie Policy.

2. Eligibility

You must be at least 13 years old, have the legal capacity to enter a binding contract, and not be prohibited from using the Service under applicable law. If using Instagrow on behalf of an organisation, you confirm you have authority to bind that organisation.

3. Your Account

3.1 Registration

You must provide accurate, complete, and up-to-date information when creating your account and keep it updated at all times.

3.2 Security

You are responsible for all activity under your account. Use a strong unique password, do not share credentials, and notify us immediately of any unauthorised access.

3.3 One Account Per User

You may not create multiple accounts to circumvent plan limits or for any abusive purpose.

4. Subscription Plans & Payments

4.1 Available Plans

• Free (₹0/month): Post scheduling and basic analytics.
• Creator (₹200/month): Post scheduling, analytics, and comment moderation.
• Advanced (₹400/month): All Creator features plus Creator Intelligence AI insights.

4.2 Free Trial

Paid plans may include a 14-day free trial. If you do not cancel before the trial ends, you will be charged for the selected plan automatically.

4.3 Billing

• Subscriptions are billed monthly in advance in Indian Rupees (INR).
• Payments are processed by Razorpay under their payment terms.
• Failed payments result in a 3-day grace period before downgrade to the Free plan.

4.4 Cancellation & Refunds

• Cancel anytime from your account settings. Access continues to the billing period end.
• No pro-rated refunds for partial months, except as required by law.
• Refund requests for exceptional circumstances must be made within 7 days of the charge.

5. Acceptable Use

You must NOT use Instagrow to:

• Harass, threaten, defame, or harm others.
• Post illegal, harmful, obscene, or infringing content.
• Send spam, phishing messages, or conduct deceptive practices.
• Gain unauthorised access to our systems or Instagram's systems.
• Reverse-engineer or extract source code from the Service.
• Resell or sublicense the Service without written permission.
• Use bots or scrapers outside the permitted API access.
• Circumvent rate limits, access controls, or security features.

Violation may result in immediate account termination without refund.

6. Instagram Platform Compliance

Instagrow uses the official Instagram Graph API. You also agree to comply with Instagram's Terms of Use, Meta's Platform Terms, and Instagram's Community Guidelines.

You are solely responsible for content scheduled through Instagrow. We are not liable for any actions taken by Instagram or Meta regarding your content or account. Instagram's evolving policies may affect certain features.

7. Intellectual Property

7.1 Our Property

All elements of the Service — design, logos, software, algorithms, and content — are owned by or licensed to Instagrow and protected by intellectual property law. You may not copy, reproduce, or distribute them without written permission.

7.2 Your Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes only.

8. Your Content

You retain full ownership of content you create or upload through Instagrow. By using the Service, you grant us a limited licence to store and process your content solely to provide the Service. You warrant that your content does not infringe anyone's rights and complies with all applicable laws.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted service, specific results (e.g., follower growth), or that Instagram's API will remain available.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTAGROW IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. Our total liability to you shall not exceed the greater of (a) fees paid in the 3 months preceding the claim, or (b) ₹500.

11. Termination

You may delete your account anytime from Settings. We may suspend or terminate accounts for Terms violations, non-payment, or abuse — with 30 days' notice except in cases of serious violation. Upon termination, your data is retained for 30 days for export, then deleted.

12. Dispute Resolution

Contact us first to resolve issues informally. If unresolved, these Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of Indian courts.

13. General Terms

• Entire Agreement: These Terms, Privacy Policy, and Cookie Policy form the complete agreement.
• Severability: If any provision is unenforceable, the rest continue to apply.
• No Waiver: Failure to enforce a right does not constitute a waiver.
• Changes: We'll notify you of material changes 14 days in advance via email or website notice.
